Competition Terms and Conditions
- The competition is open to Short Films made in the UK and Eire only and Entrants must be 16 years of age or older. Entrants under 18 on 30 October 2008 should obtain written permission from their parent or guardian and produce such permission to Digital Classics if required.
- The Short Film must be no more than 30 minutes in length, including any titles or end credits. Short Films over 31 minutes in length (including credits) will be disqualified.
- The Short Film should be no more than 400MB in file size.
- The Short Film must be in English.
- The competition is only available to those residing in the UK & Eire.
- Entrants must upload (submit) the Short Film via the Digital Classics website. Digital Classics accepts no responsibility for loss or damage of films during the uploading process.
- All Short Films must be received by Friday 9th January 2009.
- Uploading (submission) of Short Films is limited to max 5 films per person.
- Entrants selected to take part in the final round should not enter their Short Film into any other short film initiative until after the closing date of 9th January 2009. Short Films must not have been screened online or on television prior to the competition, or received any public screenings prior to the closing date of 9th January 2009.
- Digital Classics reserves the exclusive right to use the EntrantÕs Short Film to market the competition or showcase the work of Digital Classics during the submission period and up to six months after.
- Digital Classics reserves the right to refuse any entry for any reason at its absolute discretion.
- The decision of the judges is final. Neither correspondence nor discussion concerning any decision shall be entered into.
- To qualify, the Entrant must retain source film material and be able to supply such film material, in DVD format, upon request to Digital Classics within a reasonable timeframe.
- Only one name will be credited per uploaded (submitted) Short Film. The Entrant must upload (submit) only his/her own original work and agrees and confirms that this will not infringe the copyright or any other rights of any third party.
- All material created by Digital Classics featuring excerpts of the Short Film is and shall remain the property of Digital Classics in perpetuity.
- No responsibility is taken by Digital Classics for loss, damage or delay to Short Films entered.
- Digital Classics reserves the right to seek and issue publicity on behalf of the Entrant. By entering the competition the Entrant agrees to participate in publicity as reasonably requested surrounding the competition.
- The Short Film is made at the EntrantÕs own expense and Digital Classics shall not be liable to reimburse any expenses incurred in making an entry.
- Short Films must not include strong language, scenes of a clearly sexual nature or distressing scenes. Short Films that contain defamatory or obscene material are of an explicitly violent nature or are likely to incite bigotry/racial or religious prejudice will be rejected.
- Only successful Entrants will be contacted by Digital Classics
- The Entrant must ensure that all contributions to his/her Short Film or recordings or other submissions and any copyright material included in the Short Film (including music) have been cleared for all purposes of the competition under these Terms and Conditions. Any Short Films or recordings containing contributions or copyright material which has not been cleared or for which clearance cannot be obtained may be disqualified. Entrants must complete a music clearance form to qualify for the competition and supply to Digital Classics upon demand.
- By uploading (submitting) a Short Film, the Entrant:
- Grants to Digital Classics an exclusive, free licence to digitize, encode, publish and transmit his/her Short Film on the Digital Classics website, and for such other purposes (such as publicity related to the competition) as are expressly provided for in these Terms and Conditions.
- Grants to Digital Classics the exclusive right to sub-licence his/her Short Film during the Licence Period for the purpose of syndication for a DVD release.
- Grants to Digital Classics the non-exclusive right to transmit and distribute in any media now known or hereafter invented throughout the universe in perpetuity, and to sub-licence the same to any third party BAFTA sees fit.
- Grants to Digital Classics the right to copy the Short Film and to send such copies to the judges of the competition and to journalists for the purpose of reviewing the resulting DVD release.
- If his/her Short Film is chosen by Digital Classics, permits Digital Classics to make and retain, both during and after the Licence Period, a copy of his/her Short Film as may be required for Digital Classics archival and promotional purposes.
- Permits Digital Classics to edit or change the Short Film in any way it may in its sole discretion consider necessary for the purposes of the company.
- Warrants that he/she has any and all clearances necessary and that nothing in the Short Film is libelous, defamatory or infringes on copyright, right of publicity or any other rights whatsoever.
- Warrants that all persons appearing in the Short Film do so with their full consent.
- Warrants that no sums will be payable to any person whatsoever with respect to the release of the title.
- Indemnifies Digital Classics, and any associated third party against any loss or damage occurring out of any failure to gain appropriate clearances, defamation of an individual, etc.
- Agrees to his/her name being used in any publicity for the competition.
- Confirms that he/she is aged 16 years or over and is a resident of the UK.
- Digital Classics reserves the right to extend the entry deadline.
- Digital Classics reserves the right to cancel the competition at any time, without written notice to the entrants.
- Visibility on the website does not indicate acceptance into the competition. We reserve the right to exclude films at judging stages if they are in contravention of the Rules and/or Terms and Conditions.
- In the first round of judging, the top twenty films, as voted for by the public, will be put to a public vote and the five with the most votes will be selected for the final judges Š a jury of industry experts. A winner will be chosen from this selection by the judges.
- The prize for the winning entry will be top billing on a nationally-released DVD, with the next 9 entries also being included on the DVD.
- Acceptance of these Terms and Conditions and the Rules is a condition of entry and receipt of an entry by Digital Classics (upload/submission) amounts to acceptance of the Terms and Conditions and the Rules.
- If you do not want to grant Digital Classics the rights set out above, please do not upload (submit) your film.
- This competition is closed to Digital Classics and others associated with DCD Media plc.
- In the event of a tie in the public vote, the films will be reconsidered by Digital Classics. A winner will be put forward by the jury.
